Will: In the name of God Amen, I Benjamin Sandford of New Barbadoes Neck in the county of Bergen and state of New Jersey being weak in body but of sound mind and memory (for which blessing I desire to be sincerely thankful) do make and publish this my last will and testament in manner and form following that is to say first it is my will and I do here by order that all my just debts and funeral charges be duly paid as soon as convenient after my decease. Item I give and bequeath unto my beloved wife Mary Sandford (in addition to her rights of dower at common law) during her widowhood the use of my dwelling house with the lot immediately conneccted with the same of about one acre and a half together with two cows and the priviledge of keeping them on my farm and all the household furniture, which furniture I empower her to distribute as she sees fit to my daughters. Item I give and bequeath to my eldest son Elijah all my interests in the ___ Meadow being a tract of about 17 acres which I purchased of Jonathan Mulford. Item I give and bequeath to my son Enoch in case of his return (having been absent several years) the one equal half of a certain tract of salt meadow of about eleven acres connected with the New Ark causeway and should he never return it is my will that his portion of the said meadow shall fall to my said Eldest son Elijah. I also give unto my said son enoch in case of his return the new field purchased of the widow Davis containing about ten acres but this devise is made under the followin circumstances to wit. Whereas my brother Enoch at his decease bequeathed to my said son Enoch a certain farm with provision for its decent in case he should die without heirs and whereas by the concent of my said son Enoch before he was of age I conveyed to Thomas Sandford six acres of the aforesaid farm in the possession of which I indemnified the aforesaid Thomas Sandford and with the proceeds of that sale I purchased the 10 acres alluded to. Now in case my aforesaid son Enoch shall return and release the aforesaid Thomas Sandford in the possession of this six acres it is my will that the aforesaid 10 acres shall be considered in the place of the six acres of the aforesaid farm devised by my brother Enoch and descend according tyo the provision of his will. But in case my son Enoch shall refuse to confirm the sale made to Thomas Sandford it is my will that the ten acres shall be disposed of to meet the claims of this Thomas Sandford. Item. I give and bequeath to my son Ebenezer the homestead whereon I now live consisting of my dwelling house and about thirteen acres of land together with all that tract of salt meadow which I own lying on Franks Creek containing about 12 acres and also thae one equal half of the above mentioned eleven acres of salt meadow connected with the New Ark Causeway.
Item I do order that a certain bond given me by my son Elijah for the paymetns of eleven hundred dollars be at my decease given up as the proposes for which it was given expire with my life. Item I give and bequeath to my daughters Jane, Perninah and Maria each one hundred dollars to be paid out of the devises made to my sons in case my moveable estate shall be insufficient for that purpose and to be secured to them within three months of my decease. Item in case either of my children should decease under age and without lawful issue then I order and my will is that the portion herein devised or bequeathed to such child or children whall be equally divided between the remainder of my said children in equal proportions share and share alike. Lastly I hereby appoint my loving wife Mary Sandford and my dutiful son Elijah Sandford executors of this my last will and testament and guardians to my children during their minority. In witness where of I have hereunto set my hand and seal this twenty ninth day of April in the year of our Lord One thousand eight hundred and eight.599 |
